Modern realities in Ukraine require speed and flexibility, especially in the field of military logistics.

To ensure that our clients always have access to up-to-date information, we have decided to consider the topic of dual-use goods. We hope this article will help you better understand the peculiarities of working with such cargoes. We have answered the most common questions together with professional brokers.

What are dual-use goods?

These are goods, equipment, materials, software or technology that can be used for both civilian and military purposes. Their use is strictly regulated by the legislation, in particular by the Law of Ukraine No. 549-IV of 20.02.2003.

Such goods include:

  • raw materials and supplies;
  • equipment;
  • technology and scientific and technical documentation.

These goods may be used to create weapons (nuclear, chemical, bacteriological) or military equipment, so their customs clearance requires special attention.

Examples of dual-use goods

The list of such goods is approved by the Cabinet of Ministers of Ukraine. Examples include:

  • GPS systems;
  • night vision devices and thermal imagers;
  • drones and their components;
  • body armor;
  • communications systems and equipment.

Who is it relevant to?

Dual-use goods are particularly relevant to:

  • entrepreneurs using them for business purposes;
  • volunteers supplying the Armed Forces with equipment;
  • journalists working in war zones.

Now there are some simplifications in customs clearance of such goods, which will be discussed below.

How do I obtain import authorization?

If your goods belong to the dual-use category, it is necessary to apply to the State Export Control Service of Ukraine for authorization. The algorithm of actions is as follows:

  1. Submitting an application for a conclusion or authorization.
  2. Conducting an expert examination of the goods.
  3. Providing full information on the intended use.

The required documents include:

  • the purpose of importation;
  • shipping documents;
  • certificates of origin;
  • obligations on the use and non-repatriation of goods.

Timeframes for processing applications

The timeframe depends on the chosen customs regime and varies from 15 to 90 working days. In case of standard clearance the decision is made within 30-60 working days from the moment of submission of the full package of documents.

Latest news and updates

In April 2023, the Cabinet of Ministers expanded the list of dual-use goods that can be imported during martial law without additional permits. This list includes communication systems, drones, cameras, data protection equipment, etc. However, even in this case, state guarantees of their intended use are required.
